2nd Circ. Backs Jimmy Kimmel In George Santos IP Fight

The Second Circuit Court of Appeals has ruled in favor of Jimmy Kimmel, ABC, and Disney in a copyright dispute brought by George Santos, a former congressman. The court upheld the application of the fair use doctrine, dismissing Santos’ claims related to video clips he was tricked into making by Kimmel.

Santos alleged that Kimmel, ABC, and Disney infringed on his copyright by using video clips of him without permission. However, the Second Circuit found that the fair use doctrine protected the defendants in this case, as Kimmel’s use of the clips was transformative and served a different purpose than the original content.

The court’s decision not to revive Santos’ claims highlights the importance of the fair use doctrine in copyright law and sets a precedent for similar cases in the future.
