About the Course:

The Microsoft v. Motorola verdict transcends RAND, standards setting bodies and patent pools. This decision will impact how patents are drafted, how patents are prosecuted and how patents are litigated. In light of this decision, it is possible that major companies will no longer participate in standards setting bodies or limit their participation to avoid RAND issues.

This webinar begins with an introduction into the facts and circumstances surrounding the dispute between Microsoft and Motorola. Then, attendees are walked through Judge Robart’s critiques of each of the 15 Georgia-Pacific factors used to determine an appropriate royalty rate.

This session presents a unique opportunity to learn how the 15 Georgia-Pacific factors should be applied to RAND patent litigation. Specific issues addressed include:

  • Whether means plus function claims have any value as standard essential patents.
  • The risks of multiple patents having the same specifications.
  • The consequences of not having clear definitions of claim elements.
  • The wisdom of arguing that your patent is not a standard essential patent.
  • How will the Microsoft v. Motorola verdict impact injunctions.

William Sloan Coats focuses his practice on intellectual property litigation, specifically involving patents, copyrights, trademarks and trade secret disputes for the computer, electronics, entertainment and movie industries. He is the past Chair of the Science and Technology Law Section of the American Bar Association and was appointed by the U.S. government to the United Nations Centre for Trade Facilitation and Electronic Business Task Team on Intellectual Property Rights and Related Issues in 2008.
