Multiple design applications
In Saudi Arabia, It is possible to file multiple design applications. It shall include the same class of the International Classification.
Filing requirements of a design application in Saudi Arabia
In Saudi Arabia, You can submit the English and Arabic translations of the patent application at the time of its registration. You can not submit the translation at a later stage.
To obtain a filing date, it is essential to provide the Saudi Patent Office with:
– payment of the filing fees
– a request to grant a patent;
– an application for a patent containing inventor’s and applicant’s information and addresses;
– patent specification (description, claims,drawings,abstract);
– priority data, if any.
You shall submit a certified copy of the Priority Document within 3 months from the filing date.
The original of a notarized POA legalized up to the Saudi Consulate may be filed within 3 months from registration of a patent application in Saudi Arabia.
Assignment Deed between the inventor and the applicant must be submitted within 90 days from the filing date if the application is registered by a person other than the inventor, then a notarized and legalized
Examination of a design application in Saudi Arabia
In Saudi Arabia, design applications are subject to formal examination only.
Novelty grace period
Disclosure will be disregarded if it occurred:
– within six months before the registration or priority date (if any) and happened at an officially recognized international exhibition.
– Six months before registration of the application in Saudi Arabia or priority date (if any) and resulted from the abusive acts against the applicant.
Grant, validity term and design renewal fees
In Saudi Arabia, design application certificates are valid for ten years from the registration date. You shall pay the Grant fee together with publication fee within three months from the notification by the Office. Annual maintenance fees are due starting from the year following the registration date, and you can pay it from January 1 to March 31 of each year.
Duration of the registration procedure
In Saudi Arabia, it takes an average of 10-12 months to obtain a certificate for design application.
Representation by a patent attorney
For foreign applicants, it is important to appoint a local representative, patent agent, or a registered Saudi patent attorney.
