In Germany, multiple design patent applications (up to 100 designs if they have at least one common class of goods) are possible.

Filing requirements of design application in Germany

To file a design patent application in Germany, a patent application shall have the below items:-

-a request for registration.

-applicant’s and designer’s details.

-indication of the class(es) of goods.

-declaration of inventorship. 

One must submit a copy of the Priority Document within 16 months from the date of priority.

You shall submit the POA only in case the representative is not a German Patent Attorney. The POA legalization or notarization is not necessary.

Examination of a design application in Germany

In Germany, designs patent applications undergo formal examination only. The substantive examination procedure of the design patent applications in Germany is not designated.

Novelty grace period

In Germany, the novelty grace period is twelve months from the filing date or priority date. If the design application is made public by an inventor or his successor in title or by a third party, which would result in abuse in relation to the inventor or his successor in the title within the above period, it does not disapprove the novelty of the invention in Germany.

Grant, validity term and design renewal fees

The validity term of the design patent in Germany constitutes five years as of the filing date. This term is subject to renewal four times up to a maximum of twenty-five years. You can pay the renewal fees before the end of each protection period.

Duration of the registration procedure

In Germany, in case of a smooth registration procedure, the processing time from the filing to registration is approximately 2-4 weeks.

Representation by a patent attorney

Foreigners who wish to file a patent application in Germany should appoint an agent, a German patent attorney officially registered before the German Patent and Trade Mark Office.
