The evolution of intellectual property (IP) in China over the last 30 years has been remarkable, mirroring the nation's rapid economic expansion, according to Renata Righetti Pelosi, president of the International Association for the Protection of Intellectual Property (AIPPI). In a recent interview with China Intellectual Property News, Pelosi emphasized China's emergence as a significant player in the global IP landscape, driven by sustained efforts to foster, protect, and leverage intellectual property assets.
Data from the World Intellectual Property Organization's (WIPO) annual World Intellectual Property Indicators report reveals that patent applications filed with China's IP administration surged by 11.6 percent year-on-year to 1.54 million in 2018. This figure represents nearly half of the global total, underscoring China's dominant role in patent activity worldwide.
Beyond volume, the quality of Chinese patent filings has notably improved, particularly in cutting-edge fields such as artificial intelligence, mobile communications, high-speed rail, and biopharmaceuticals. The National Intellectual Property Administration (NIPA) highlights that these high-value patents are key drivers of economic growth and social welfare.
Pelosi attributed much of the patent filing growth to Chinese technology giants including Huawei, Oppo, ZTE, and BOE Technology. These companies ranked among the top 100 patent filers at the European Patent Office in 2018, signaling their leadership in innovation not only domestically but also on the global stage.
Central to these achievements is the Chinese government's unwavering commitment to promoting IP creation, protection, and utilization. Pelosi noted that this rapid IP development reflects China's strategic shift from a manufacturing-based economy to one driven by science and technology innovation.
China's IP system, established in the 1980s, is relatively young compared to Western counterparts that have evolved over centuries. The country began by learning from established models and joined WIPO in 1980. Since then, China has acceded to nearly all major international IP conventions, building a comprehensive legal framework encompassing the Trademark Law, Patent Law, Copyright Law, and Regulations on the Protection of New Varieties of Plants. These laws are regularly updated to align with evolving international standards and agreements such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).
Administrative procedures for IP applications have been modernized and streamlined. By the end of 2019, the average processing time for high-value patent applications was reduced to 17.3 months, while trademark registrations averaged 4.5 months. These efficiencies place China among the countries with the most effective examination systems, according to NIPA.
The entire examination process has transitioned to digital platforms, with an intelligent examination system under development to further enhance efficiency.
Effective utilization of IP is a core objective of China's strategy. In 2018, the added value of patent-intensive industries exceeded 10 trillion yuan (approximately $1.43 trillion), contributing over 15 percent to GDP growth, as reported by NIPA.
Small and medium-sized enterprises (SMEs) have increasingly leveraged IP assets as collateral to secure financing, while poverty-stricken regions have utilized geographical indications to boost local living standards.
Looking ahead, Pelosi recommended continued reforms to further streamline procedures for obtaining IP rights, ensuring that China's IP system remains responsive to innovation demands and international best practices.
