Comprehensive UK Case Law Resource on Standard Essential Patents Updated

The UK Intellectual Property Office (IPO) has updated its Standard Essential Patents (SEPs) Resource Hub to feature an expanded collection of relevant UK case law concerning SEPs. This section serves as a centralized reference point for legal professionals and parties involved in SEP licensing and litigation, providing access to key court decisions and related guidance.

The Resource Hub highlights the complexities of SEP disputes, which often arise during licensing negotiations. It directs users to the "Dispute resolution and remedies in SEP licensing" guidance, which explores the various types of disputes that may occur and outlines the services and options available to resolve these conflicts, including court litigation.

Included in the updated resource is a non-exhaustive list of significant UK SEP cases, organized by court and presented in reverse chronological order. The cases cover a range of SEP issues adjudicated by UK courts, with links to full judgments for detailed review.

The IPO emphasizes that SEP litigation is a global phenomenon, with multiple jurisdictions worldwide hearing and deciding on SEP-related disputes. The Resource Hub also references WIPO Lex for international legal information and directs users to WIPO Lex Frequently Asked Questions for further assistance.

Importantly, the IPO clarifies that the UK SEPs case law information provided is for guidance purposes only. It does not constitute legal, business, financial, or professional advice and should not be solely relied upon for making intellectual property or business decisions. The IPO disclaims responsibility for any use of the information and recommends seeking appropriate professional advice.

The IPO commits to ensuring the accuracy and currency of the information at the time of publication but does not accept legal responsibility for any errors or omissions, including those on third-party websites linked within the resource.

On 19 May 2025, the IPO added additional cases to the tables covering the UK Court of Appeal and the England and Wales High Court of Justice, further enriching the resource.

The Resource Hub also invites feedback from users to improve the GOV.UK website experience, providing a survey link for visitors.

This comprehensive and regularly updated UK SEPs case law resource supports transparency and accessibility in SEP dispute resolution, assisting stakeholders in navigating the evolving legal landscape surrounding standard essential patents in the UK.

Users seeking detailed information on UK SEP litigation and dispute resolution options are encouraged to consult this resource alongside professional legal counsel to inform their strategies and decisions.
