FTI Technology's Forensic Analysis Secures Favorable Settlement in Aviation IP Dispute

An intellectual property dispute between two aviation industry companies escalated to litigation with potential criminal charges, prompting an extensive investigation into alleged IP misappropriation. FTI Technology was retained to provide expedited forensic analysis and expertise in emerging data sources to support evidence discovery for the litigation.

The client’s CEO maintained that neither the company nor a group of implicated engineers had stolen or meaningfully used any competitor intellectual property. FTI Technology’s exhaustive analysis of devices and cloud-based platforms—including Google Workspace, Slack, and Bitbucket—validated these assertions.

The forensic team conducted a comprehensive examination of 80 devices and multiple cloud sources, producing a detailed declaration of findings within a month. This report formed the evidentiary basis that supported the client’s position throughout the litigation.

Throughout the investigation, FTI Technology’s experts interviewed employees and key custodians, collaborating closely with legal counsel and senior leadership to guide the investigative process and develop a strategic response plan.

During the course of the analysis, the team identified additional relevant data sources that were incorporated into the scope to ensure a complete and defensible review, further disproving the allegations against the client.

FTI Technology’s processes and methodologies were rigorously documented and defensibly verified, with the team providing testimony via depositions and court filings to substantiate the findings.

The expert testimony delivered by FTI Technology in court conveyed critical facts and supporting evidence, which played a pivotal role in securing a last-minute settlement agreement favorable to the client.

Over a two-year period, FTI Technology continued to advise the client on search methodologies and findings, ensuring the defensibility of forensic and e-discovery efforts by all parties involved. Their specialized technical skills and investigative experience reassured stakeholders and effectively supported the client’s litigation strategy.
