A patent serves as a legal safeguard for technical solutions, allowing inventors to commercialize their developments while protecting them from unauthorized exploitation. Alina Parkhuta, an intellectual property lawyer at the "Logic" law firm, recently detailed the patentability requirements and frequent errors made by applicants in Ukraine.
Inventors who have developed new devices, enhanced production technologies, or created original technical methods must prioritize securing formal legal protection. Without a patent, others may use these technical solutions without permission, undermining the inventor’s rights.
In Ukraine, patent registration enables the acquisition of intellectual property rights for inventions or utility models. These rights facilitate commercial use, transfer to third parties, and enforcement against unlawful use. However, not every idea qualifies for patent protection. The choice between patenting an invention or a utility model depends on the nature of the technical solution and the legal conditions for protection.
Before submitting an application, it is crucial to accurately determine the subject of patenting, evaluate its patentability, and prepare documentation in compliance with legal standards.
Ukrainian legislation offers protection for technical developments primarily through patents for inventions or utility models. The appropriate category depends on the development’s essence and characteristics.
An invention is defined as the result of intellectual and creative activity in technology that meets statutory patentability criteria. It may pertain to:
- A product, such as a device, substance, chemical composition, microorganism strain, or cell culture.
- A process or method, including production technologies or material processing techniques.
Examples include a novel water purification device, a chemical substance with specific properties, or a unique manufacturing technology.
Utility models, by contrast, cover technical solutions that also qualify for patent protection if they meet legal requirements. Their subject matter can be devices or methods. Examples include improved designs of lighting or massage devices or innovative methods for performing technological operations.
Parkhuta emphasizes that abstract ideas, business concepts, or mere desired outcomes do not qualify for patents. Legal protection is granted only to specific technical solutions fulfilling legal criteria. If the primary value lies in a product’s appearance rather than technical features, registering an industrial design is more appropriate. For protecting names, logos, or other distinctive marks, trademark registration is the suitable route.
To obtain a patent for an invention in Ukraine, the technical solution must satisfy three key patentability requirements:
1. Novelty: The invention must be new and not part of the prior art, with public disclosures before the relevant date considered.
2. Inventive Step: The invention should not be obvious to a skilled person based on existing knowledge; it must demonstrate a creative contribution.
3. Industrial Applicability: The invention must be capable of practical use in industry or other fields.
For utility models, only novelty and industrial applicability are required; the inventive step criterion does not apply.
