NMSU Expands Patent Holdings Amid Funding Challenges for Intellectual Property Office

New Mexico State University (NMSU) has expanded its intellectual property portfolio to encompass 56 active patents alongside 26 pending applications, signaling robust research commercialization progress. This update was presented by Arrowhead Center Inc. to the NMSU Board of Regents during their meeting on August 18.

The portfolio currently comprises five provisional patent applications, 20 non-provisional applications, and one international application still under review. University officials report an uptick in commercialization activities, with researchers increasingly disclosing inventions, pursuing patent protections, and exploring licensing opportunities.

Despite this growth, Arrowhead’s report to the Regents highlighted significant resource constraints faced by the university’s Intellectual Property Office. Institutional funding is reportedly insufficient to meet the operational needs required to effectively manage patenting and commercialization processes.

In response, NMSU is formulating a comprehensive intellectual property strategy and budget plan aimed at securing enhanced institutional support. Interim Arrowhead Director Yu-Feng “Winnie” Lee emphasized the office’s intention to collaborate with university leadership to establish a funding formula that better supports patent and licensing activities.

A notable example of NMSU’s commercialization success involves cybersecurity technology developed at the university. The MARS/MABE technology—short for multi-authority attribute-based encryption—has been licensed to Atriarch/CyberCatch LLC, which is advancing a quantum-resistant cybersecurity product.

Arrowhead’s report further noted that Datavault AI has announced plans to acquire CyberCatch in an all-share transaction valued at approximately $136.8 million. It was clarified that this figure represents the acquisition value of CyberCatch and does not equate to direct revenue for NMSU. The university’s financial returns will depend on the specific terms of the licensing agreement and the commercial performance of the technology.

During the Regents meeting, Lee expressed optimism that the licensed cybersecurity technology will begin generating licensing revenue for the university in the near future.

In addition to commercialization efforts, the Intellectual Property Office is finalizing a $40,000 grant from the New Mexico Bioscience Authority to support an initial bioscience commercialization market research program. The office is also collaborating with Health Inno on a $110,000 initiative aimed at advancing intellectual property commercialization within the healthcare sector.

Furthermore, NMSU and the University of New Mexico’s Rainforest Innovations have jointly submitted a proposal to the National Science Foundation seeking additional funding to bolster commercialization activities.

These developments underscore NMSU’s commitment to translating research innovations into commercial products despite current funding challenges. The university’s leadership continues to pursue strategic partnerships and funding avenues to strengthen its intellectual property infrastructure and maximize the impact of its research portfolio.
