UK Intellectual Property Office Enhances Patent Application Speed Through Multiple Acceleration Programs

The UK Intellectual Property Office (IPO) offers multiple methods to accelerate the processing of patent applications, aiming to reduce the time to grant for eligible inventions. Applicants seeking faster patent grants can consult the IPO's Patents fast grant guide for detailed instructions on expediting their applications.

One notable program is the Green Channel, launched on 12 May 2009. This service enables applicants to request accelerated processing if their invention provides an environmental benefit. Eligible inventions might include solar panels or wind turbines, where a simple statement of environmental advantage suffices. More complex cases, such as manufacturing processes that reduce energy consumption, require additional explanation. The IPO does not conduct detailed investigations into these claims but will reject requests that are clearly unfounded, such as those involving perpetual motion machines. Importantly, acceleration under the Green Channel is only granted upon applicant request; there is no automatic fast-tracking based on technology area.

The IPO maintains a searchable database of published applications and granted patents that have benefited from Green Channel acceleration, promoting transparency and awareness of the program.

For international patent applications filed under the Patent Cooperation Treaty (PCT), the Green Channel acceleration is available during the national phase, provided the claims have been deemed acceptable in the International Preliminary Examination Report or the International Searching Authority's written opinion. Beyond the Green Channel, the IPO participates in the Patent Prosecution Highway (PPH) initiative. The PPH allows applicants to significantly speed up examination if a corresponding application has already been examined and found allowable by another intellectual property office. This program leverages prior examination work to improve efficiency and patent quality, potentially resulting in earlier patent grants.

The Global Patent Prosecution Highway (GPPH) pilot, launched in January 2014, extends this concept by enabling applicants with allowed claims at one participating office to request accelerated examination of co-pending applications at other participating offices. All offices involved evaluate acceleration requests based on a common set of criteria, streamlining the process across jurisdictions.

A comprehensive list of GPPH participating offices is available on the PPH Portal. The GPPH supersedes previous bilateral agreements the IPO had with other offices, consolidating acceleration efforts under a unified framework.

Applicants seeking accelerated processing under the GPPH must follow the specific guidelines set forth by the IPO and the participating offices to ensure compliance and eligibility.

These acceleration pathways demonstrate the IPO's commitment to facilitating timely patent protection, particularly for inventions with environmental benefits or those already examined abroad. By utilizing these programs, applicants can reduce delays and bring innovations to market more swiftly.
