Israel's copyright regime for 2026 is governed primarily by the Israeli Copyright Act, which sets forth specific requirements and categories for copyright protection. To qualify for copyright subsistence in literary, artistic, musical, and dramatic works, three main criteria must be met: originality, fixation in any form, and a connection to Israel. This connection typically means that the work was first published in Israel or that the author was an Israeli citizen or habitually resident in Israel at the time of creation. Additionally, protection may arise under applicable international treaties such as the Berne Convention and TRIPS Agreement.
The Israeli Copyright Act operates with a closed list of eligible work categories. Only works explicitly enumerated in the statute qualify for copyright protection, excluding any works outside this list. Protected categories include literary works—encompassing lectures, tables, compilations (including databases), and computer programs in any form or expression—artistic works such as photographic works, maps, charts, architectural works, and applied art including typefaces, as well as dramatic works like choreography, musical works, and sound recordings.
Works not falling within these statutory categories are excluded from copyright protection. Furthermore, designs are generally excluded unless they are neither used nor intended for industrial manufacture, defined as the production of more than 50 articles incorporating the design. Official publications are also excluded from copyright protection.
Certain subject matter is explicitly excluded from copyright protection, including ideas, procedures, methods of operation, mathematical concepts, facts or data, and news of the day. However, copyright may subsist in the original expression of these elements.
Israel does not maintain a formal system for copyright registration. Consequently, registration is not a prerequisite for protection, and the act of registration does not affect the existence or enforcement of copyright rights.
The duration of copyright protection varies by type of work but generally extends for the life of the author plus 70 years. For joint works, protection lasts for the life of the longest surviving author plus 70 years. If the author is unknown, protection endures for 70 years from the date of publication or, if unpublished within 70 years of creation, 70 years from the date of creation. Sound recordings and typeface works enjoy protection for 70 years from the date of publication. State works are protected for 50 years from the date of creation. All terms conclude at the end of the calendar year in which the protection expires.
Regarding overlaps with other intellectual property rights, designs used or intended for industrial manufacture are excluded from copyright protection but may be protected under design rights. In rare cases where a design is not intended for industrial manufacture, it may enjoy both design and copyright protection. Israel does not recognize a sui generis database right; however, databases may be protected by copyright if there is originality in the selection or arrangement of data.
Works produced by industrial processes face restrictions in copyright protection. Specifically, designs incorporated into industrial manufacture of more than 50 articles are excluded from copyright protection.
The legal status of AI-generated works remains unsettled under Israeli law. The Copyright Act does not explicitly address AI-generated content, and no judicial rulings have yet clarified this issue. A March 2023 decision by the former Israeli Commissioner of Patents, currently under appeal, held that AI-generated inventions are not patentable as inventorship requires a human being. Israeli courts are expected to apply a similar standard for copyright, limiting protection to works created by human authors and excluding those generated solely by AI without human involvement.
