House Judiciary Subcommittee to Examine IP Rights for AI-Generated Inventions and Creative Works

The House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet announced a hearing scheduled for Wednesday, April 10, 2024, at 10:00 a.m. Eastern Time. The hearing, titled "Artificial Intelligence and Intellectual Property: Part III – IP Protection for AI-Assisted Inventions and Creative Works," will delve into the complex issues surrounding intellectual property (IP) rights in the context of artificial intelligence (AI).

The focus of the hearing is to evaluate the standards and policy considerations relevant to granting IP protection for inventions and creative works generated with AI assistance. Specifically, the subcommittee will examine whether existing patent and copyright frameworks sufficiently address AI contributions and if current or proposed rules on inventorship and authorship require modification.

Witnesses scheduled to provide testimony include Claire Laporte, Intellectual Property Fellow and former Head of Intellectual Property at Ginkgo Bioworks, Inc.; Joshua Landau, Senior Counsel for Innovation Policy at the Computer and Communications Industry Association; and Sandra Aistars, Clinical Professor at George Mason University Antonin Scalia Law School.

The hearing represents the third installment in a series exploring the intersection of artificial intelligence and intellectual property law. It aims to inform legislative and regulatory approaches as AI technologies increasingly influence innovation and creative processes.

Key topics expected to be addressed include the criteria for recognizing inventors and authors when AI tools contribute to the creation of inventions or expressive works, the adequacy of current IP protections in incentivizing innovation involving AI, and the potential need for new legal standards or guidelines.

By convening experts from academia, industry, and policy organizations, the subcommittee seeks to gather diverse perspectives on how intellectual property law can evolve to keep pace with technological advancements.

The hearing will be accessible to the public and is part of ongoing congressional efforts to understand and regulate the implications of AI on intellectual property rights.
