New MOU aims to streamline intellectual property dispute processes for SMEs and startups through arbitration and valuation expertise

Korean Arbitration Board and Invention Promotion Association Collaborate to Boost Out-of-Court Patent Dispute Resolution

As competition in technology sectors intensifies, disputes involving intellectual property rights such as patents, trademarks, and trade secrets have become increasingly common. Small and medium-sized enterprises (SMEs) and startups face significant challenges due to the high costs and lengthy timelines associated with traditional litigation. Recognizing this, two leading Korean institutions have joined forces to develop a more efficient dispute resolution framework.

On June 12, the Korean Commercial Arbitration Board (KCAB) and the Korea Invention Promotion Association (KIPA) formalized their cooperation by signing a Memorandum of Understanding (MOU) at the Jeong In-ho Hall of KIPA. Founded in 1966, the KCAB is Korea’s sole permanent statutory arbitration institution, offering arbitration, mediation, conciliation, and consultation services to resolve disputes involving domestic and international companies.

The collaboration aims to prevent intellectual property disputes arising during the utilization of IP assets and to establish a professional, streamlined resolution system drawing on the complementary expertise of both organizations. Specifically, the agreement promotes the expanded use of arbitration mechanisms tailored to the unique characteristics of IP disputes.

Given that patent and technology valuation plays a critical role in resolving such disputes, the parties intend to incorporate KIPA’s intellectual property valuation models into arbitration and mediation procedures. Historically, patent disputes have been complicated by divergent assessments of technological merit and market value between disputing parties. By applying objective valuation criteria, the organizations anticipate improving the efficiency and fairness of dispute resolution outcomes.

Beyond dispute resolution, the partnership will also pursue joint initiatives including intellectual property education programs, seminars, and forums. These efforts aim to bolster the IP protection capabilities of SMEs and startups and to foster proactive dispute prevention strategies.

Shin Hyun-yoon, President of the Korean Commercial Arbitration Board, emphasized the significance of the partnership: “Through the cooperation between the two organizations, a foundation will be laid to more actively utilize the arbitration system in intellectual property disputes.” He further noted, “We expect that the combination of the Korea Invention Promotion Association’s excellent intellectual property valuation capabilities and the Board’s dispute resolution functions will create synergy for resolving complex intellectual property disputes more efficiently.”

The growth of technology-driven industries in Korea has led to an uptick in disputes related to patents, trademarks, and technology transfer agreements. This trend has increased demand for swift and cost-effective alternatives to court litigation, such as arbitration and mediation.

By leveraging their respective strengths, KCAB and KIPA aim to enhance the overall intellectual property dispute resolution ecosystem. The partnership is expected to expand support services and provide SMEs and startups with more accessible and effective tools to manage IP conflicts, ultimately fostering innovation and business growth in Korea’s competitive technology landscape.
