Latin America IP and Data Protection Developments: Argentina’s Patent Delays, Brazil’s AI Strategy, and Bolivia’s Digital Expansion

Argentina continues to face significant challenges with its patent approval system, where applications often experience delays exceeding ten years. This persistent backlog undermines innovation and deters foreign investment, prompting calls from experts for comprehensive legal and procedural reforms to bring Argentina’s patent framework in line with international standards.

In a regulatory advancement, Argentina has implemented a new protocol governing cryptoassets. This framework establishes clear compliance guidelines for financial institutions and cryptocurrency exchanges, enhancing anti-money laundering controls and reducing legal uncertainty in the digital finance sector.

The Argentine Fintech Chamber has raised concerns about the sector’s growth being hampered by a heavy tax burden. Industry representatives argue that high taxation limits competitiveness, stifles innovation, and discourages investment in fintech enterprises.

Despite economic challenges, analysts forecast growth in Argentina’s startup ecosystem, anticipating an increase in high-growth companies and unicorns. This optimism is fueled by rising venture capital interest and ongoing digital transformation efforts.

To bolster national cybersecurity, Argentina has launched a new program aimed at strengthening defenses against digital threats. The initiative focuses on increased investment in cybersecurity education and fostering cooperation between public and private sectors.

In fiscal policy, the Argentine government continues its strategy of closing state-managed trust funds to enhance transparency and accountability, aiming to prevent misuse of public resources.

Bolivia’s National Intellectual Property Service (SENAPI) reported over 35,000 intellectual property registrations in 2024, encompassing trademarks, patents, and copyrights. This milestone reflects growing awareness and protection of IP rights among Bolivian businesses and entrepreneurs.

Bolivian açaí producers have patented an innovative harvesting harness designed to improve worker safety and efficiency. This invention addresses physical strain issues and supports productivity in the expanding açaí industry.

The Bolivian government has announced an ambitious plan to achieve 100% digital connectivity nationwide, with a focus on extending internet access to rural areas. This initiative aims to close the digital divide and enhance economic opportunities through improved connectivity.

However, experts highlight Bolivia’s urgent need for updated cybercrime legislation. The current legal framework lacks protections against modern threats such as data theft and online fraud, leaving individuals and businesses vulnerable and prompting calls for swift regulatory reforms.

In Brazil, the Patent and Trademark Office (BPTO) has renewed its Patent Prosecution Highway (PPH) agreement with China. This renewal facilitates faster patent examination processes for filings in both countries, benefiting innovators by reducing waiting times and improving patent protection efficiency.

Brazil has enacted a new bio-inputs law to promote agricultural innovation. The legislation provides clear regulations for the development and commercialization of sustainable agricultural technologies, including biological pesticides and fertilizers, reinforcing Brazil’s leadership in agritech.

The BPTO also reported a surge in trademark, patent, and software registration applications in 2024, indicating increased interest in intellectual property protection across diverse industries.

To enhance user experience, the BPTO launched a pilot program enabling direct communication with applicants. This initiative aims to reduce processing delays and improve efficiency by providing users with timely updates and clarifications on their filings.

The Ministry of Science, Technology, and Innovation (MCTI) unveiled a national strategy to accelerate artificial intelligence development in Brazil. The plan includes increased research investment, incentives for AI-driven businesses, and regulatory guidelines to ensure responsible AI deployment.

Brazil is also investing in quantum technologies, equipping leading laboratories with advanced tools to position the country as a key player in quantum computing and communication research.
