French luxury fashion house Louis Vuitton Malletier has taken the China National Intellectual Property Administration (CNIPA) to court in an administrative lawsuit, according to a notice published by the Beijing Intellectual Property Court in May. The lawsuit also names a Chinese individual, Huang Minyao, as a third party in the proceedings.
Details regarding the specific trademark dispute at the heart of this lawsuit have not been disclosed in the court notice. However, Louis Vuitton’s legal actions in China frequently involve trademark conflicts, often with local businesses.
This legal move comes amid ongoing backlash related to a trademark dispute involving a Chinese milk tea chain, highlighting the challenges international brands face in protecting their trademarks in China’s complex market.
Louis Vuitton is no stranger to litigation in China. In 2023 alone, 58 judgments and court summonses involving the company have been published on China’s official court announcement platform, with the majority concerning trademark disputes.
Further, court notices compiled by Qichacha, a Chinese corporate database, indicate that Louis Vuitton has 11 additional trademark infringement cases scheduled for hearings between mid-July and the end of August.
This is not the first occasion Louis Vuitton has sued China’s trademark regulator. In March, the Beijing Intellectual Property Court heard a similar administrative lawsuit where CNIPA was the defendant alongside a third-party individual, also brought by Louis Vuitton Malletier.
The repeated legal confrontations underscore Louis Vuitton’s aggressive approach to safeguarding its brand in China, a key market for luxury goods, and reflect the ongoing tensions between foreign brands and Chinese trademark authorities.
As trademark disputes continue to surface, Louis Vuitton’s litigation strategy signals its commitment to defending its intellectual property rights through China’s judicial system, despite the complexities and challenges inherent in the local regulatory environment.
