Horacio Gutiérrez, a distinguished alumnus of the University of Miami School of Law, currently holds the position of head of global affairs and chief legal counsel at Spotify, the world’s leading music streaming service. In this role, he manages Spotify’s global legal, regulatory, and government affairs, while also serving as corporate secretary to its board of directors. He leads the company’s global licensing operations, negotiating commercial agreements with record labels, music publishers, performance rights organizations, and other rights holders worldwide.
Gutiérrez’s legal career is deeply rooted in intellectual property law, a field in which he has been actively engaged throughout his tenure at Spotify and previously at Microsoft. At Spotify, he is part of the ongoing antitrust litigation involving Apple, alongside other major industry players such as the creators of Fortnite, challenging the terms and conditions imposed by Apple for hosting apps on its App Store.
A native of Venezuela, Gutiérrez’s academic journey includes a law degree from Venezuela (1986), an LL.M. from Harvard Law School (1991), and a J.D. from Miami Law (1998). He credits his Miami Law education, particularly its focus on international law, as a transformative foundation that propelled his career forward. “My years at Miami Law truly were transformational,” Gutiérrez remarked, emphasizing that his U.S. legal credentials combined with his civil law background distinguished him professionally.
Following graduation, Gutiérrez joined Microsoft, initially serving as a commercial attorney for Latin America based in Fort Lauderdale. His career at Microsoft spanned 17 years, during which he held multiple international roles: from general counsel for Europe, the Middle East, and Africa in Paris to executive officer and deputy general counsel at Microsoft’s Redmond headquarters. His responsibilities included overseeing innovation, intellectual property, licensing, and corporate affairs across Microsoft’s global product and service lines.
Recognizing the underrepresentation of Hispanic law students in intellectual property law, Gutiérrez founded the Hispanic National Bar Association/Microsoft Intellectual Property Institute in 2013. This program annually immerses 25 law students nationwide in a comprehensive week-long IP law experience in Washington, D.C. The institute offers substantive instruction, practical workshops, and visits to key U.S. government institutions such as the Patent and Trademark Office, Copyright Office, Federal Trade Commission, and legislative bodies. Miami Law students have been consistently selected to participate since the institute’s inception.
Beyond his corporate roles, Gutiérrez maintains strong ties to Miami Law, returning to teach short courses, deliver commencement addresses, and present at the Entertainment, Arts and Sports Program’s annual industry conferences. His expertise and influence have been recognized repeatedly; Billboard magazine regularly includes him in its Power 100 list of the music industry’s most influential figures and has named him among the top music lawyers. Miami Law’s Inter-American Law Review honored him as “Lawyer of the Americas” in 2013.
In public addresses, Gutiérrez has highlighted the critical role of patents and intellectual property in global commerce, noting that patents have evolved into a form of currency essential for free world trade. He personally manages the filing of approximately 7,000 patent applications worldwide each year.
Gutiérrez’s multicultural perspective and extensive international experience, developed through years living and working across the United States, Europe, and Latin America, inform his leadership at Spotify. His career reflects a blend of legal acumen, cultural fluency, and strategic vision in navigating complex intellectual property landscapes in the technology and music industries.
