Six months after a fully AI-generated video depicting Tom Cruise battling Brad Pitt went viral, the technology responsible has been adapted to better protect Hollywood’s intellectual property and likeness rights. On Monday, the Motion Picture Association (MPA) announced it had reached a Memorandum of Understanding (MOU) with ByteDance, the Chinese tech giant, to implement strong safeguards within ByteDance’s AI platforms.
The MOU covers Seedance, the AI video model that created the viral Cruise vs. Pitt video, as well as Seedream 5.0 Lite, TikTok, CapCut, Dreamina, and other related platforms. This agreement marks a significant step in addressing the challenges posed by AI-generated content that can replicate likenesses and copyrighted material without authorization.
The development of Seedance and the resulting agreement bear resemblance to OpenAI’s Sora video model, which launched last year and initially produced numerous unauthorized videos featuring famous characters and individuals. OpenAI ultimately discontinued Sora earlier this year after agreeing to curtail such unauthorized uses.
Unlike OpenAI, ByteDance continues to invest in Seedance, which has emerged as one of the most advanced AI video models alongside offerings from companies like Google. The MPA and ByteDance’s collaboration reflects a shared commitment to balancing innovation with respect for intellectual property rights.
Charles Rivkin, Chairman and CEO of the MPA, emphasized the importance of copyright protections in the film and television industry. “Today’s agreement illustrates our belief that copyright is a cornerstone of the film and television industry – and reinforces our commitment to protect creative content,” Rivkin said. He noted that the MPA has engaged constructively with ByteDance over recent months to implement meaningful guardrails on Seedance and Seedream, and that the MOU reflects their mutual determination to strengthen these protections further.
John Rogovin, General Counsel of ByteDance, echoed this sentiment, stating, “ByteDance respects the intellectual property rights that underpin creative industries around the world, and we believe responsible innovation in AI goes hand in hand with meaningful protections for rightsholders.” He added that the company values its productive engagement with the MPA and its members and views the MOU as establishing an important framework for ongoing collaboration as AI technology evolves across multiple products and platforms.
This agreement comes amid increasing scrutiny of AI-generated content and its potential to infringe on copyrights and personal likenesses. By partnering with the MPA, ByteDance aims to position its AI offerings as responsible and respectful of creative rights, setting a precedent for other technology companies developing generative AI tools.
