MPA and ByteDance collaborate to implement enhanced copyright protections in AI video and image generation tools following legal challenges

Motion Picture Association and ByteDance Forge Groundbreaking AI Copyright Agreement

The Motion Picture Association (MPA) announced on Monday that it has secured its first formal agreement with an artificial intelligence company, ByteDance, aimed at bolstering copyright protections in AI-generated content. ByteDance, a Chinese technology firm and former majority owner of TikTok’s U.S. operations, has agreed to implement enhanced guardrails within its AI tools Seedance and Seedream, which generate videos and images respectively from text prompts.

The MPA, representing major Hollywood studios including Disney, Netflix, and Sony Pictures Entertainment, confirmed months of constructive dialogue with ByteDance to address concerns over unauthorized use of copyrighted material. The agreement follows a February cease-and-desist letter from the MPA to ByteDance, which alleged that Seedance 2.0 had been trained on copyrighted works without permission and was producing unauthorized videos featuring protected characters such as SpongeBob SquarePants and scenes reminiscent of the sci-fi series Stranger Things.

"Today’s agreement illustrates our belief that copyright is a cornerstone of the film and television industry – and reinforces our commitment to protect creative content," said Charles Rivkin, MPA Chairman and Chief Executive. The February letter, penned by MPA global general counsel Karyn Temple to ByteDance’s global general counsel John Rogovin, accused ByteDance of "pervasive and widespread infringement" of its members’ intellectual property.

In response, ByteDance acknowledged the concerns and committed to strengthening safeguards to prevent unauthorized use of intellectual property and likenesses. Since then, ByteDance has released updated versions of its AI tools—Seedream 5.0 Pro and Seedance 2.5—that incorporate advanced IP protections, as noted in a joint statement from ByteDance and the MPA.

"ByteDance respects the intellectual property rights that underpin creative industries around the world, and we believe responsible innovation in AI goes hand in hand with meaningful protections for rightsholders," said John Rogovin in the statement.

Seedance has gained traction among independent filmmakers who view it as a cost-effective AI video generation solution. However, the rapid deployment of AI tools by technology companies has raised concerns within the entertainment industry about the unauthorized use of copyrighted content during AI training and output generation.

The MPA’s engagement with ByteDance represents a significant step toward establishing industry standards for AI-generated content and protecting the rights of content creators. The agreement underscores the importance of balancing technological innovation with respect for intellectual property rights in the evolving digital landscape.

This development arrives amid broader industry debates regarding AI’s impact on creative works, including ongoing discussions about consent, compensation, and the use of likenesses in AI-generated media.

The MPA and ByteDance’s collaboration may serve as a model for future partnerships between Hollywood and AI companies seeking to navigate the complex intersection of technology and copyright law.
