New Delhi Court Grants Permanent Injunction to Huda Beauty Against Counterfeit Cosmetics Importer

Huda Beauty has successfully secured a permanent injunction from the District Commercial Court in New Delhi against Vision Enterprises, a company involved in importing counterfeit cosmetics into India. The court’s ruling prohibits Vision Enterprises from importing, selling, or advertising products bearing trademarks identical or deceptively similar to those registered by Huda Beauty.

The legal action originated after Indian Customs intercepted a shipment of imitation Huda Beauty products at Kolkata Port. Upon investigation, Huda Beauty confirmed the seized goods were counterfeit and initiated legal proceedings against Vision Enterprises.

In its judgment, the court found clear evidence of trademark infringement. It granted a permanent injunction to Huda Beauty, effectively barring Vision Enterprises from further infringing activities involving the brand’s registered trademarks.

Additionally, the court directed Indian Customs authorities to destroy the counterfeit products in accordance with the Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007. This enforcement measure aims to prevent the circulation of fake cosmetics in the Indian market.

Huda Beauty substantiated its claims by presenting comprehensive evidence of its trademark registrations, its global brand presence, and established retail partnerships within India, including collaborations with prominent retailers such as Nykaa and Sephora.

Notably, Vision Enterprises did not contest the allegations, which contributed to the court’s decisive ruling in favor of Huda Beauty.

This ruling highlights the effectiveness of India’s judicial and customs enforcement mechanisms in addressing the persistent challenge of counterfeit imports, particularly in the beauty and cosmetics industry.

Counterfeit cosmetics pose significant risks, including damage to brand reputation, financial losses, and potential health hazards for consumers. The court’s decision serves as a critical precedent for protecting intellectual property rights and consumer safety in India’s rapidly growing beauty market.

The case reflects broader efforts by global beauty brands to safeguard their trademarks and maintain market integrity amid increasing counterfeit activity.
