Taylor Swift has taken a proactive legal step to shield her voice and image from the emerging threats posed by artificial intelligence technologies. On Friday, she filed trademark applications with the United States Patent and Trademark Office (USPTO) for two audio clips and one photograph, all intended to protect her persona from unauthorized AI-generated content.

The filings are notable for including "sound marks," a relatively uncommon form of trademark protection. Josh Gerben, a US-based trademark attorney and founder of Gerben IP, highlighted in a recent blog post that registering a celebrity’s spoken voice as a trademark is an innovative approach that remains untested in courts.

One of the audio clips features Swift saying: “Hey, it’s Taylor Swift, and you can listen to my new album, ‘The Life of a Showgirl,’ on demand, on Amazon Music Unlimited.” The other clip has her stating: “Hey! It’s Taylor. My brand new album ‘The Life of a Showgirl’ is out on October 3rd and you can click to pre-save it so you can listen to it on Spotify.”

Alongside these sound marks, Swift seeks to trademark an image depicting her on stage during her recent Eras tour. The photograph shows her holding a pink guitar and wearing a sequinned outfit, capturing an iconic moment from her globe-spanning performances.

These applications add to the extensive portfolio of trademarks owned by Swift’s company, TAS Rights Management, which has filed over 300 trademark applications in the United States alone. Intellectual property expert Leticia Caminero of the World Intellectual Property Organization notes that such a strategy helps to reinforce an artist’s brand in a rapidly evolving digital landscape.

The move underscores the challenges AI presents to the entertainment industry. AI tools can generate highly realistic videos and music that mimic well-known performers without directly copying existing works, thereby circumventing traditional copyright protections.

Gerben explains that while copyright law protects original recordings, AI-generated content that imitates an artist’s voice or likeness without duplication creates a legal gap. Trademark law, particularly through sound marks and image trademarks, may offer a novel avenue to address this gap.

Similar filings have been made by actor Matthew McConaughey, who has sought trademark protection for his voice and image in recent months. These efforts collectively test new legal theories on how trademark law can adapt to the AI era.

In practical terms, if Swift’s trademarks are approved, she could potentially bring legal action against unauthorized uses of her voice or image that resemble the registered marks, including AI-generated content that attempts to replicate her persona.

This development signals a broader trend among celebrities and rights holders to explore trademark law as a tool to protect personal identity and brand integrity against the rapid proliferation of AI-generated media.

As AI technologies continue to evolve and disrupt traditional IP frameworks, Swift’s filings may serve as a precedent for how artists and entertainers safeguard their creative and personal assets in the future.
