According to the USPTO, faxed documents often suffer from poor reproduction quality within their systems and require labor-intensive manual handling. These factors contribute to processing delays, which in turn extend wait times for applicants. By discontinuing fax filings, the USPTO aims to focus resources on substantive examination issues and normalize processing timelines.
Applicants who are unable to access the USPTO’s electronic filing system by their deadline still have options. They may mail or hand-deliver their documents accompanied by a petition to accept paper. To ensure timely filing status, submissions must be deposited in a U.S. Postal Service collection box on the filing deadline date. Including the USPTO’s coversheet certifies that the filing was made on time.
This change also brings the USPTO’s practice into alignment with its existing rules. Although the rules have long stated that faxed filings are not accepted, a temporary exemption was granted when the agency introduced identity verification requirements. This exemption was designed to ease the transition for filers. However, demand for the exemption has since declined significantly, with nearly all filers having completed identity verification.
The USPTO encourages trademark applicants to review alternate filing options available on its website for guidance on submitting documents electronically or through other means if online filing is inaccessible.
