USPTO’s Standard-Essential Patent Working Group Advances Support for Innovators and Stakeholders

The U.S. Patent and Trademark Office (USPTO) has reaffirmed its commitment to supporting innovation through its Standard-Essential Patent (SEP) Working Group. Established to address challenges faced by SEP holders, the group focuses on restoring robust remedies, facilitating meaningful participation in standards development organizations (SDOs), and promoting transparency throughout the innovation ecosystem.

One of the Working Group’s key initiatives is the SPARK (Standards Participation and Representation Kudos) Pilot Program. This program incentivizes active and meaningful participation in SDOs by U.S.-based small and medium-sized businesses, universities, and nonprofit organizations, aiming to broaden representation and input in standards-setting processes.

Beyond programmatic efforts, the SEP Working Group serves as a centralized point of contact for various SEP-related matters. Stakeholders are encouraged to report issues concerning SEPs, submit considerations for potential amicus briefs, and provide general input to help shape ongoing policy and procedural developments.

To facilitate communication, the USPTO invites anyone with SEP concerns or feedback to reach out via email at SEPWorkingGroup@uspto.gov. This channel is intended to foster dialogue and ensure that diverse perspectives are heard within the patent and standards communities.

The USPTO also advises recipients of its communications to verify that their email security settings do not block access to embedded links, recommending that IT administrators whitelist specific domains to ensure uninterrupted access to USPTO content.
