USPTO Director Squires Highlights Emerging Trademark Challenges at INTA London Conference

LONDON, ENGLAND — United States Patent and Trademark Office (USPTO) Director John A. Squires delivered a keynote address at the International Trademark Association (INTA) Annual Meeting in London, focusing on the evolving challenges and opportunities in trademark law related to personal branding and name, image, and likeness (NIL) rights.

In his speech titled “Where the Puck is Going: Branding America’s Branding Agency to Meet NIL and the Trademark Issues of Tomorrow,” Director Squires addressed an international audience about the agency’s efforts to adapt to the rapidly changing landscape of trademarks in the context of collegiate athletics, professional sports, and entertainment.

Director Squires highlighted how the USPTO is positioning itself to empower individuals and entities navigating the “new frontier” of personal branding. He noted the intersection of NIL rights and trademarks as a particularly dynamic area, reflecting recent developments in collegiate sports where athletes are increasingly monetizing their personal brands.

Drawing on cultural references, Squires remarked that trademark practitioners are "taking a page out of Matthew McConaughey’s and Taylor Swift’s new playbook," emphasizing that a proactive federal trademark registration strategy may serve as the best defense against emerging threats such as AI-generated deepfakes.

He posed a critical question to the audience: "What does this bold move mean more globally for entertainment stars, influencers, and personal branders seeking protection beyond current right to publicity regimes?" This inquiry underscored the potential for trademark law to expand protections in ways that traditional publicity rights may not fully address.

The Director’s remarks reflected a forward-looking vision for the USPTO as it seeks to meet the challenges posed by technological advancements and the evolving nature of personal brand commercialization.

For practitioners and stakeholders, the address signaled an increased emphasis on federal trademark registration as a strategic tool to safeguard personal brands in an era of AI and digital media proliferation.

The full text of Director Squires’ as-delivered remarks is available on the USPTO website, providing further insights into the agency’s approach to these emerging trademark issues.
