Alnylam Fails to Revive Patent Infringement Suit Against Moderna

Alnylam Pharmaceuticals Inc. faced a setback in its patent infringement case against Moderna Inc. as the US Court of Appeals for the Federal Circuit upheld a claim construction decision made by a Delaware district court.
In a ruling on Wednesday, Judge Richard Gary Taranto stated that Alnylam did not succeed in proving that the district court's adoption of a definition from Alnylam's patent specification regarding a chain of carbon atoms was erroneous.
The legal dispute arose when Alnylam accused Moderna of infringing on two of its vaccine-related patents, namely Nos. 11,382,979 and 11,246,933. Alnylam alleged that Moderna's mRNA Covid-19 vaccine contained a molecule that fell under the scope of the patents in question.
Despite Alnylam's efforts to revive the patent infringement suit, the Federal Circuit's decision means that the case will not be reopened, marking a significant legal victory for Moderna in this intellectual property dispute.
