M/s. Puja Entertainment (India) Ltd. achieved a significant legal victory on May 6, 2024, when the Court of Civil Judge (Senior Division)-I in Katihar issued an interim order protecting the company’s intellectual property rights against unauthorized exploitation. The proceedings were initiated against Tips Music Limited and other parties for allegedly misusing valuable rights linked to some of Bollywood’s most celebrated films and music catalogues.
The disputed works include iconic films produced under the Puja Entertainment banner such as Coolie No. 1, Hero No. 1, Biwi No. 1, Bade Miyan Chote Miyan, Tera Jadoo Chal Gayaa, and Mujhe Kucch Kehna Hai. The matter also involves the proposed release and commercial exploitation of the film Hai Jawani Toh Ishq Hona Hai.
Puja Entertainment approached the Hon’ble Court after uncovering ongoing unauthorized dissemination, monetization, and commercial use of its films, music rights, sound recordings, and underlying works across various platforms including streaming services, broadcasting channels, and digital media.
Upon hearing the case, the Court granted interim protection and issued a detailed status quo order directing all parties to maintain the existing state of affairs concerning the disputed intellectual property. The Court emphasized that failure to provide immediate relief would cause serious and irreparable harm to Puja Entertainment’s proprietary and statutory rights.
This ruling represents a historic recognition of producer rights within the Indian entertainment sector. For years, producers have raised concerns about unauthorized exploitation of legacy film libraries and music catalogues without proper authorization or consent. The Court’s order reaffirms the fundamental principle that no cinematograph film, music catalogue, sound recording, or proprietary film library may be commercially exploited or monetized without explicit consent from the rightful producer and owner.
Representing Puja Entertainment, V K Dubey Associates confirmed that the Court’s directive to maintain status quo must be strictly observed by all parties involved. The firm highlighted that the order not only protects financial interests but also safeguards the emotional, reputational, and legacy aspects tied to the producer’s creative contributions.
Puja Entertainment underscored that each film library embodies decades of struggle, creative vision, financial investment, artistic input, and goodwill painstakingly built over generations. Unauthorized exploitation inflicts not only financial damage but also irreparable emotional loss and dilution of the producer’s identity and reputation.
The company further stated that this landmark order brings to light previously unaddressed dishonest and unlawful exploitation practices impacting valuable intellectual property within the entertainment ecosystem.
