Teva Drops Inhaler Patent Infringement Lawsuit Against Amneal

Teva Pharmaceutical Industries Ltd. has decided to end its legal battle against Amneal Pharmaceuticals of New York LLC and its affiliates over allegations of patent infringement related to Teva's asthma inhaler.

The lawsuit, which was being heard in the US District Court for the District of New Jersey, was dismissed without prejudice by Judge Stanley R. Chesler. This decision came after both parties filed a letter seeking to terminate the suit.

The dismissal occurred just before Teva was set to submit a petition to the US Supreme Court to challenge an appeals court ruling that upheld Judge Chesler's order from June 2024. The order stated that five of Teva's patents were infringed upon.
