Brandy Melville Takes Swing at Temu in New Intellectual Property Lawsuit

Brandy Melville has recently initiated a legal battle against Temu for alleged copyright and trademark infringement. The lawsuit, filed in a New Jersey federal court, accuses Temu of permitting the sale of counterfeit Brandy Melville products on its platform. Brandy Melville argues that Temu goes beyond being a mere hosting platform by actively participating in marketing, pricing, fulfillment, and shipping of products sold by independent sellers on its platform.

The Swiss parent company of Brandy Melville, Y.Y.G.M. SA, and its U.S. operator Bastiat USA, have taken legal action against Temu and its parent company, PDD Holdings. The lawsuit claims that Temu’s business practices indicate control over its independent sellers, making it liable for intellectual property violations.

Brandy Melville alleges that Temu’s surge in popularity among U.S. consumers is attributed to the exploitation of intellectual property rights, resulting in near-identical products being sold at lower prices on the platform. The complaint specifies that Temu infringed on Brandy Melville’s copyrighted Eye Fabric Design and trademarks such as “Brandy [heart] Melville,” “Chill Since,” and “Radio Silence.”

The legal action targets not only Temu but also 10 Doe defendants, likely sellers on the platform whose identities are unknown. Brandy Melville seeks preliminary and permanent injunctions to prevent further infringement, the destruction of infringing products, and substantial financial damages.

This lawsuit is not the first of its kind for Brandy Melville, as the company previously engaged in legal battles over intellectual property rights with other entities. Temu, on the other hand, is facing multiple legal challenges, including alleged violations of consumer privacy and data sharing.

Temu has not responded to requests for comment on the allegations made by Brandy Melville. The outcome of this legal dispute will have significant implications for the enforcement of intellectual property rights in the e-commerce marketplace.
