Judge Recommends Tossing Nielsen Data Patent Case

A federal magistrate judge in Delaware has recommended the dismissal of a lawsuit filed by Nielsen Holdings PLC against a rival, VideoAmp Inc., alleging patent infringement. The lawsuit pertained to a patent covering a method for measuring audience viewership outside the home using mobile phone data.
The judge found that the patent in question does not cover an eligible process, leading to the recommendation for the case to be tossed out.
The lawsuit was filed in the U.S. District Court for the District of Delaware and involved the U.S. Patent and Trademark Office. The patent at the center of the dispute is numbered 12,063,402 and is titled “Methods and apparatus to correlate census measurement data with panel data.”
Law firms Fish & Richardson, Kelley Drye, and Potter Anderson represented the parties involved in the case. The recommendation for dismissal was made by the federal magistrate judge following a thorough review of the patent and the allegations of infringement.
