Celerity IP, backed by litigation finance firm GLS Capital, has been building momentum in its enforcement push, reportedly initiating proceedings against more than 15 companies over the past year. These cases center on patents originally owned by Taiwanese electronics giant Asus and affiliated entity Innovative Sonic. The portfolio includes a number of standard-essential patents (SEPs) relating to wireless communication technologies—critical components for smartphones and other connected devices.
The most recent UPC filings against Xiaomi and Oppo underscore the attractiveness of the new European patent system to patent holders seeking centralized and efficient enforcement. The UPC, operational since June 2023, allows rights holders to litigate a single patent across multiple EU member states, reducing the cost and complexity of multi-jurisdictional battles.
Celerity IP’s actions appear strategic and systematic. The firm’s enforcement campaign has so far extended to Microsoft, Google, and other tech giants, targeting both established corporations and emerging players in the mobile space. Legal experts say this could signal the beginning of a new wave of coordinated SEP enforcement in Europe.
While Xiaomi and Oppo have yet to issue public statements on the lawsuits, industry insiders expect the companies to mount robust defenses. Both have extensive experience navigating patent litigation in Europe, China, and the U.S., often dealing with complex cross-licensing disputes and FRAND (fair, reasonable, and non-discriminatory) licensing issues.
Celerity IP is likely leveraging the structure of the UPC system, which allows for powerful preliminary injunctions and efficient case resolution timelines. The UPC’s growing caseload—particularly in Düsseldorf and Munich—suggests that more rights holders may turn to this forum to resolve complex patent disputes with international tech firms.
GLS Capital’s involvement also adds an interesting layer. As litigation funding becomes more prevalent, firms like Celerity IP gain the resources to pursue high-cost, high-stakes cases without immediate financial risk. This trend is reshaping the dynamics of global IP enforcement, particularly in jurisdictions offering robust legal frameworks like the UPC.
