China National Intellectual Property Administration Affirms Validity of Harbour BioMed's Patent; Infringement Lawsuit Moves Forward

Harbour BioMed, a global biopharmaceutical company specializing in antibody therapeutics for immunology and oncology, received confirmation from the China National Intellectual Property Administration (CNIPA) regarding the validity of its patent amidst an infringement lawsuit.

The CNIPA upheld Harbour BioMed's patent titled "Binding Molecule" (Patent Application No. CN201210057668.0, known as the HCAb Patent) on June 5, 2025. The patent covers a method for producing fully human heavy chain-only antibodies (HCAbs) using transgenic animals.

Harbour BioMed had filed a patent infringement lawsuit against Biocytogen Pharmaceuticals with the Shanghai Intellectual Property Court on September 27, 2024. The lawsuit alleged that Biocytogen's RenNano platform infringed on Harbour BioMed's HCAb Patent. Biocytogen challenged the court's jurisdiction, but the Supreme People's Court of China dismissed the appeal on May 27, 2025, affirming the Shanghai Intellectual Property Court's jurisdiction over the case.
