DraftKings Scores Legal Victory as Court Tosses Most of WinView’s Patent Claims

WinView asserted that DraftKings incorporated these patented features into its mobile app without authorization, constituting willful patent infringement. However, on July 11, 2025, U.S. District Judge Georgette Castner ruled in favor of DraftKings on several key issues.

Judge Castner dismissed the infringement claims related to the ‘543 patent entirely, citing a lack of sufficient factual detail to support the allegation. She also struck down WinView’s claim of willful infringement, noting that DraftKings had previously challenged the patent successfully through the Patent Trial and Appeal Board (PTAB). In a prior ruling, the PTAB had invalidated many of the claims in the '543 patent during an inter partes review, further weakening WinView's position in court.

However, the court did not dismiss the entire case. The judge allowed WinView’s direct infringement claim involving the ‘988 patent to move forward. Since DraftKings had not filed a motion to dismiss that specific claim, it remains active. This means the legal battle is not entirely over, but WinView’s overall case has been significantly narrowed.

This ruling marks a notable development in the growing legal friction within the mobile gaming and fantasy sports industries, where innovation and IP ownership are critical to competitive advantage. As companies increasingly rely on patented technologies to differentiate their platforms, IP litigation has become more common—and high stakes.

DraftKings, a major player in the fantasy sports and online betting market, has remained firm in its position that it does not infringe on WinView’s patents and welcomed the court’s decision as a validation of its approach. A spokesperson for the company said the ruling reflects the strength of their legal and technical defenses.
