GoPro filed the complaint in 2023, alleging that Insta360 infringed on multiple patents covering key innovations in its popular HERO camera line. Specifically, GoPro accused Insta360 of violating patents related to digital stabilization, distortion correction, aspect-ratio switching, horizon leveling, and the physical design of the camera itself.
In the initial determination issued by ITC Judge Monica Bhattacharyya, the commission found that Insta360 had indeed infringed GoPro’s design patent protecting the look and shape of the HERO camera. The judge also found infringement on two patents tied to GoPro’s acclaimed HyperSmooth video stabilization and virtual-lens technologies—features central to the HERO’s market appeal.
However, in a partial victory for Insta360, Judge Bhattacharyya cleared the company of infringing GoPro’s remaining claims, finding that several other patents were either not infringed or invalid. Notably, the ITC judge dismissed GoPro’s claims concerning some of its broader software-based technologies, weakening part of the company's argument.
In response, Insta360 expressed cautious optimism, noting that the majority of GoPro’s accusations were rejected. The company confirmed it is already in the process of implementing design changes that will prevent future issues and plans to challenge aspects of the ruling it deems overreaching. Insta360 maintains that innovation and fair competition drive its success and that it respects IP laws globally.
GoPro, meanwhile, welcomed the ruling as a step toward protecting its pioneering technology. The company stated that the decision underscores its commitment to defending its R&D investments and ensuring fair play in the rapidly growing action camera industry.
While the current decision is not final, it carries weight. The ITC will issue a final ruling by November 10, 2025, which could include the possibility of import bans or product exclusions for infringing Insta360 models entering the U.S. market.
