Samsung Gets Reprieve as Patent Firm Drops Injunction Bid in High-Stakes IP Battle

The lawsuit, filed in the Eastern District of Texas, accuses Samsung of infringing several of Radian’s patents related to SSD data management. Radian initially sought a preliminary injunction to bar Samsung from selling the allegedly infringing products while the case moved forward—a rare and aggressive move for an NPE, especially following the landmark eBay Inc. v. MercExchange decision that made such injunctions significantly harder to obtain for non-operating patent holders.

However, in a recent court filing, Radian informed the court that it was withdrawing its motion for preliminary injunction. The move comes after an unusual intervention from the DOJ and USPTO, who submitted a joint “statement of interest” urging courts not to categorically deny injunctions to NPEs simply because they do not manufacture or sell products. This marked a notable shift in federal policy and suggested that NPEs might still be entitled to injunctive relief if they could demonstrate irreparable harm or a strong likelihood of success on the merits.

Despite this federal backing, Radian’s decision to drop the injunction motion indicates a strategic recalibration. Some legal analysts speculate that the move could be an effort to avoid protracted procedural battles and instead focus on pursuing monetary damages or a potential settlement.

The implications of this case go far beyond the courtroom. It has reignited debate over the role and rights of NPEs in the patent ecosystem. Critics often label NPEs as "patent trolls" who exploit the system to extract settlements, while supporters argue that these entities play a critical role in enforcing intellectual property rights and supporting innovation, especially for small inventors and startups who rely on licensing revenue.

For Samsung, the withdrawal is a temporary win—it avoids a potential disruption to its SSD product lines while the broader litigation plays out. Yet the federal interest in this case sends a clear signal: the government is willing to reevaluate longstanding biases against NPEs in patent enforcement.
