Patent Attorney Sanctioned Over Netflix Docs — But Dodges Contempt Ruling

Netflix, who is locked in a patent dispute with one of Ramey’s clients, accused the attorney of breaching confidentiality and sought a civil contempt ruling against him. They claimed that sharing the protected data with AiPi — a funder who was evaluating the lawsuit for potential financial backing — undermined the court's authority and put Netflix's trade secrets at risk.

However, U.S. District Judge Jon S. Tigar ruled that while Ramey’s actions were improper and merited monetary sanctions, they did not rise to the level of civil contempt. The judge acknowledged the seriousness of the protective order violation but noted that there wasn’t sufficient evidence of bad faith or harm to justify holding Ramey in contempt of court.

"Violating a protective order is a serious matter," Judge Tigar wrote in his opinion, “but sanctions, not contempt, are the appropriate remedy in this instance.”

As a result, Ramey was ordered to pay reasonable attorneys’ fees and costs to Netflix as a penalty. The exact amount will be determined following a motion from Netflix.

The ruling is significant not only because of the high-profile nature of the parties involved — Netflix being one of the most prominent tech and entertainment platforms globally — but also because it touches on growing concerns about third-party litigation funding in patent cases. Increasingly, IP plaintiffs are turning to financial backers to support costly litigation, raising legal and ethical questions about access to confidential information.

For Netflix, the decision offers a partial win. While the company didn’t get the contempt ruling it wanted, the court did recognize that their confidential data had been mishandled and imposed financial consequences on Ramey. The decision may also serve as a warning to attorneys and funders about the importance of respecting court-imposed confidentiality in high-stakes IP litigation.
