Republican Senators Call on Trump Administration to Fill Vacant IP Post and Use Tariff Negotiations for Drug Pricing Goals

In a recent development, 18 Republican Senators have penned a letter to U.S. Trade Representative (USTR) Jamieson Greer and Secretary of Commerce Howard Lutnick, urging the Trump Administration to leverage trade negotiations to reduce drug prices for American citizens. The senators also emphasized the importance of appointing a Chief Innovation and Intellectual Property Negotiator to address imbalanced pharmaceutical pricing.
The move comes after President Donald Trump issued Executive Order 14297, titled “Delivering Most-Favored-Nation Prescription Drug Pricing to American Patients,” aiming to significantly lower drug prices for U.S. citizens. The order proposes implementing a “most favored nations” policy to ensure Americans pay prices similar to the lowest-paying nation, potentially reducing costs by 30% to 80%.
The senators applauded this initiative but stressed the need for the Administration to engage with U.S. trading partners to negotiate commitments to eliminate market-distorting price controls. They recommended appointing a senior official at USTR for such negotiations and filling the vacant position of Chief Innovation and Intellectual Property Negotiator, established by Congress in 2015.
According to the role outlined in 19 U.S.C. § 2171(c)(6), the Chief Innovation and Intellectual Property Negotiator is tasked with conducting trade negotiations, enforcing trade agreements related to U.S. intellectual property, and addressing foreign government policies impacting U.S. innovation.
The senators highlighted that appointing an experienced Chief Innovation and Intellectual Property Negotiator would signal the U.S.'s commitment to rectifying pharmaceutical pricing disparities and ensuring effective implementation and enforcement of secured commitments in the long term.
While the U.S. Department of Health and Human Services announced collaboration with pharmaceutical companies to communicate most favored nation price targets, reports suggest companies lack sufficient details to comply with Trump’s demands.
Senator Todd Young (R-IN) led the letter, emphasizing ongoing tariff negotiations as a tool to pressure countries to eliminate market-distorting price controls and equalize drug prices for Americans. The senators urged Commerce and USTR to prioritize and resolve unfair foreign government policies in support of American workers and patients.
