Squires' Responses to Senate Judiciary Committee Focus on Balance, Backlog and 'Born Strong' Patents

The nominee for U.S. Patent and Trademark Office (USPTO) Director, John Squires, has provided written responses to the Senate Judiciary Committee following his recent testimony. In his responses, Squires addressed various topics related to patent quality, PTAB statistics, and patent examination efficiency.

During the Senate Judiciary Committee hearing, Squires discussed the error rate at the USPTO based on PTAB statistics. He clarified his stance on the quality of patents issued by the Office, emphasizing that the statistics on claim cancellation at the PTAB are not indicative of overall patent quality at the front end.

Squires highlighted the importance of patents being "born strong," advocating for the identification of prior art at the earliest stages of examination or post-issuance to ensure robust patents from the outset. He also expressed the need to analyze trends in PTAB proceedings against marketplace data to understand issues such as missed prior art and underutilization of third-party submissions.

Regarding discretionary denials of inter partes reviews (IPRs), Squires noted a decrease in the denial rate and expressed a desire to explore avenues for redress if confirmed as Director. He emphasized the importance of a balanced approach and working with stakeholders to fulfill Congressional intent regarding PTAB operations.

When questioned about potential alterations to PTAB authority or restrictions on IPR access, Squires affirmed his commitment to a balanced approach and indicated no intentions to limit access to IPRs. He also addressed concerns about undisclosed third-party litigation funding, emphasizing the need for transparency at the PTAB regarding real parties in interest.

Squires further discussed his interest in leveraging AI tools for patent quality improvement, investigating patent thickets in the pharmaceutical sector, and clarifying eligibility law for enhanced American competitiveness. He pledged to prioritize reducing the USPTO patent application backlog through collaboration with stakeholders and leveraging tools such as AI.

The Senate Judiciary Committee Executive Business Meeting listed Squires for a future vote, indicating ongoing scrutiny of his nomination for USPTO Director.
