USPTO Rejects Snoop Dogg's Bid to Trademark ‘Smoke Weed Everyday’

A company linked to rapper Snoop Dogg has faced a setback as the United States Patent and Trademark Office (USPTO) rejected its application to trademark the phrase ‘Smoke Weed Everyday’. The application was submitted by Dr. ETC Holdco, LLC, the entity managing Snoop Dogg’s intellectual property, with plans to use the phrase for a retail store selling cannabis products and related items.
The USPTO denied the application citing two main reasons. Firstly, the phrase ‘Smoke Weed Everyday’ was deemed too widely used in cannabis culture to function as a trademark. It is commonly found on various merchandise on online platforms like Amazon, WeDreams, and Redbubble. Secondly, since the proposed store would sell cannabis products, it would violate federal law under the Federal Food, Drug, and Cosmetic Act, which prohibits the sale of foods containing unsafe additives like cannabis.
While the rejection does not prevent Snoop from using the phrase for his store, it does block federal registration, limiting nationwide enforcement rights. Snoop Dogg could potentially appeal the decision, but faces challenges due to the federal legality of cannabis sales and the widespread use of the phrase.
The delay in reviewing the application for nearly two years was attributed to the USPTO’s practice of assigning cannabis-related applications to specialized examiners due to the evolving legal landscape around cannabis products.
Despite the trademark setback, Snoop Dogg can still use the ‘Smoke Weed Everyday’ phrase for his store activities. The refusal only impacts the federal registration aspect.
